higher for mitt romney. >> looks like the hottest day of the week. get ready for triple digits. more of that coming up. >> pretty big conference coming in san francisco. big road closure. tell you what it is coming up. >> good morning. it's monday october 1st . i'm michelle griego. >> i'm frank mallicoat. >> temperatures today could reach triple digits and may have been a factor in the death of an elderly woman. kate has more. >> reporter: good morning. that's right. police say they don't know what caused her death but heat may be a factor. with days like these you want to be careful if you are an elderly person or a child. these are the days you are most vulnerable. the bay area quality is reaching unhealthy levels. it is spare the air day. that means the air quality

is poor. residents should reduce drivering. these are the days you want to take advantage of public transit, carpool or bike to work. people with respiratory problems need to be particularly careful. officials say they are vulnerable during these times. we have a couple tips for you to stay cool. one, obviously, drink fluid and don't wait until you are thirsty. stay away from alcoholic drinks or sugary drinks. these are the days to stay in doors. if you can manage to stay in air conditioned place or take advantage of malls, open areas, libraries, things like that. also, instead of blasting the fans. they are a good alternative to stay good, take a cool shower. that might be a better bet and light weight clothing. those are a few of

the tips that the cbc did list making sure you do stay cool. a few cooling centers will be opened in the east bay city. that's another way you can beat the heat. cbs 5. >> thank you. those are good tips there. >> or stay inside. we were watching the raider game at your house. i walked outside after the game depressed of course. but it was so hot. we forgot how warm it was. >> i know. and it's going to get hotter. >> we have very few days like this left. you want to enjoy it but be careful. head to the ocean, a good day to dip those toes out in the water. nice clear skies all the way to the coastline right now. you can already see mild temperatures to begin the day. by the afternoon, it is going to be hot in many spots. high pressure sitting overhead. the skies nice and clear out toward the beaches. these temperatures are going to be running well above average. fairly pleasant at this time of year.

peninsula, more road work on westbound 92 to southbound 280 connecter ramp. coming up a check of mass transit. it is spare the air day. encouraged to use mass transit if you can. back to you guys. >> thank you. right now the coast guard is leading the search from two fisherman. they were thrown from a boat that capsized. alisa is on the coast with the latest on the search. >> reporter: good morning. that search continues throughout the night. the coast guard has a boat on the water searching for those two fisherman. they've been missing since yesterday morning when they were hit by a large wave and flipped over. this was off the san mateo coast near pigeon point. four people were on board and motored out for a fishing trip.

around 10:30 a.m. the wave hit. two of them made it to shore. they alerted that their friends were missing. >> one of the subjects self rescued and able to crawl and make his way up to this farm house and call 911. there was about an hour delay. >> the coast guard used aircraft and boats to search cht the fishing boat drifted to shore. no clothing or tools of the people that went over board. cbs 5. >> thank you. an 84-year-old woman is under arrest. police say she was driving a car that hit a man crossing the street near uc berkeley. a man in his 20s is in critical condition. police think that alcohol may have been a factor in the crash

>> 5:06 now. three people are recovering after a drive by shooting. happened yesterday afternoon on the southbound high 101 at the holly street exit. tied up traffic for hours. witnesses reported seeing a car swerving. turns out the gunman in a car shot multiple times at the car that crashed two men and a woman were injured and taken to the hospital. one of them was hit by the gunfire. the holly street off ramp reopened about 9:00 last night. san jose are trying to solve a fatal stabbing that happened near barnell road. dozens of people were fighting at 1:00 sunday morning. 34th murder of the year. >> this morning, a trial is scheduled to start for a woman accused of killing a san mateo

nursing student. charged with murdering 26-year-old michelle lei over a dispute over a boyfriend. her body was found four months later in a remote area. >> today the sus september in a mass shooting in oakland will be back in court. appear in a pretrial hearing. accused of killing 7 people in april. he has pleaded not guilty. if convicted, he could get the death penalty. >> plastic bag ban expands and all starts today. no longer be grocery stores requiring shoppers to bring one or pay for one. unless customers have a reuse annual bag, they will be charged 10 cents for a paper back. restaurants will be added next year. other bay area headlines, sales taxes are higher today in four cities across the bay area.

up by one-half of 1% in all four cities. 8.75% now. sales tax in s onoma is 8.5%. all the increases were passed by the voters. easier now to find a seat on cal trains. also revive four discontinued trains. agency says rider ship hit a new high so they are adding more trains. >> a tech invasion this week as oroco attracts 50,000 people. described his vision of engineering hardware that works together. >> oracle 12 c is the foundation for an ex panning business -- expanding business.

state to ban a controversial therapy aimed at making a gay minor become straight. governor brown signed the bill saying it bans not scientific therapies that have driven young people to depression and suicide. the ban is an infringement on parent's rights to provide psychological care for their own children. a new poll shows president obama with a lead in swing states. mr. obama with 51% support compare today 44% for republican mitt romney. now in one of those states, nevada, as he prepares for the first debate. the two men will face off in denver on wednesday. son carry carrie. supporters say both men are ready.

back now at 5:15. a key traffic artery back opened in southern california. live pictures as construction on inner state 405 finished hours ahead of schedule. the traffic is back. the main project the demolition reportedly went smoothly, sort of. used the closure to repair pot holes and trim trees. there was a little unscripted drama to the sequel. a big chunk of bridge fell unexpectedly. officials say a couple construction workers got out of way just in the nick of time. >> i don't think i would be under there. >> that is good. 5:15. let's get a check on the roads. >> quiet out there. looking for anything new that may be

coming in. pretty good. you can actually see it outside. here's a live look . everything is easy right now heading into san francisco. if you want to head out early, you can go out now. elsewhere, we'll show you live traffic sensors. if you are commuting, we have overnight road work on southbound 101. this does not appear to be the case this morning. all the way down and heading across the golden gate bridge. also, westbound highway 4 seeing a few break lights now. not too many. otherwise the eastbound lanes of highway 4 approaching baily road. scheduled until about 1:00 this afternoon. that's going against the commute. here is a live look across the golden gate bridge. not as much fog. overall, looking pretty good . and westbound 580 drive. a few break lights.

international forces. yesterday, a u.s. soldier and american contractor were killed in an inside era tack over the weekend. attacks across iraq have killed 34 people over the weekend. 25 of the killings came in car bombings and shootings in the baghdad area. a suicide car bomber killed five policeman at a checkpoint. seen as a display of force. activists say 12 people were killed today when troops bombed a northern town near the turkish boarder. five children were among those who died. many other people are said to be wounded. attack was in an area that seen intense fighting. >> a lot of money for two guns sold at an auction in new hampshire. they once belonged to the outlaw bonnie and clyde.

the 49ers went to the big apple hoping to rebound for last week's loss to minnesota. >> they did in a big way. no match for the niners defense or offense. they were crushed and stuffed. no problem whatsoever. they scored 34 and win in in a blowout 34-0. how long can you go as the raiders get crushed in the mile high stadium. results for the first quarter carving up oakland quickly. the raiders held their own going into the half. they were only down 4. second half was ugly. the raiders lose it big. final score 37-6. i was watching the rider cup. on to baseball now, giants in san diego wrapping up a series. not at his finest. he had another shaky start for the

a third day in a row. it will be a spare the air day. that's the season's 10th day for the bay area. the bay area quality management district recommends residents to find other ways to get to work. biking, carpooling or taking public transit. it's not only the elderly and children but those with any type of breathing problems should be careful. poor air quality can trigger asthma chest pain and other respiratory problems. we do have tips to keep in mind. drink water. it doesn't matter if you are sitting at a desk or out exercising, don't wait until you are thirsty. and outdoor happy hours are tempting in this nice sunlight, you should limit alcoholic drinks and suggest arrestee drink -- sugary drinks. it's a good day to take

advantage of shopping malls and public libraries. a better way to cool off, take a cold shower. these are tips according to the cdc and also as you are picking your outfit, choose light weight, light colored or loose fitting clothes. as far as the bay area is concerned, we know cooling centers will be available in some cities for neighbors to take advantage of. if you are outdoors or plan to be exercising, stick to the morning hours, that's a better time to take a jog. cbs 5. >> wait until 7:00 when we're off the air. >> one other tip. go to the beach today. it is just the primovera day to go. >> there are very few days like this to get out to the beach and enjoy those nice beautiful temperatures.

this is a good day to do it. lots of sunshine coming our way as high pressure sitting overhead. skies mostly clear. and the temperatures are very mild. 62 in oakland. 61 in liver more . and 58 in san francisco. by the afternoon again these temperatures going to soar. usually in the 70s and 80s. fairly warm. today is going to blow that by way above the average as much as 21 degrees at about 102 in liver more. and about 93 in san jose. much cooler weather to come. talk about that in a moment. let's check out the roads with elizabeth. a lot of overnight road work has been picked up. san mateo county westbound 92. remains shut down. checked in with cal trans and it is scheduled to wrap up in the next half hour.

mile off pigeon point. alisa is in san mateo now. >> reporter: 19 hours now these fisherman have been missing and the search has been nonstop. a boat on the water now searching overnight and once the sun comes out, they'll send out aircraft to look. the 23 foot striper that left the san francisco area before dawn yesterday. they motored out and it was around 10:30 in the morning when that wave hit. >> they were hit by a 15 foot rogue wave at which time knocked all four into the water. they started getting pounded by additional waves and two made it to shore. and two are still outstanding. >> the two who made it to shore were wearing life jaekts. but their friends were not.

the coast guard used boats, a helicopter and a plane to sear ach. the names have not been released. and no update on the condition of the two who did make it to shore. >> thank you. it may be a drunk driving case. a man in his 20s was critically injured when a car hit him at berkeley. hearst avenue and spruce street last night. closed part of the avenue for the investigation. >> police are still looking for a sus september in a freeway shooting southbound highway 101 closed at the holly street exit after the victim's car crashed along the off ramp. it was a red dodge charger riddled with bullets before it crashed. two men and a woman were injured. one of them had been hit by gunfire. >> a trial gets underway for a woman accused of killing a nursing student.

many swing states. the poll shows mr. obama with 51% support compared to 44% for mitt romney. the poll surveyed voters in more than half a dozen states. susan mcginnis joins us live. >> reporter: good morning. everybody is getting sick of these polls. it is what they show that the president has within reach the 270 electoral votes needed to win. he is still coming under lots of criticism over handling of foreign affairs >> more than 11,000 people packed a high school in las vegas sunday night to listen to president obama. >> we'll win nevada again. we'll win this election against. >> last scheduled appearance before the first presidential debate on wednesday. >> governor romney he's a good debater. i'm just okay. >> romney fit in another rehearsal after church in boston

on sunday. he's not practicing since june. his running mate paul ryan says this will not be a defining moment. >> i don't think one event is going to make or break this campaign. >> parentally not everyone got the memo to downplay expectations >> thursday morning you are going to be scratching your heads and say wow we have a barn burner for the next 33 days. >> wednesday's debate will focus on domestic issues including the economy. romney is talking more about foreign policy and slamming the president. >> in this morning's wall street journal, the president has shown weakness in the middle east. he says president obama has heightened the prospect of conflict. can provoke aggression and encourage disorder. white house aides say the president is looking forward to debating foreign policy with mitt romney. >> promised a few things. end the iraq war , he did.

take the fight to al-qaida and degrade them. he has. >> major foreign policy speech to deliver in the next few weeks. >> and foreign policy is the subject of the debating come up on october 22nd. that one is in florida >> mr. romney, we know, is behind in the the polls in the swing states and after that gaff, what's it going to take for him to turn a little for this debate? >> reporter: it won't be easy. it is possible. he's going to have to turn things around. strong debate performances and he really needs to take a lot of these states where he's battling the president where the president has a lead in a lot of swing states. florida, colorado, nevada, north carolina, new hampshire. paul ryan is right. people aren't focused until the debates >> first time we've seen them

cons 05 key traffic artery is back opened in southern california. live pictures as you can see. traffic is flowing on interstate 405. they finished hours ahead of schedule last night. the main thing was the demolition of the bridge went smoothly. crews used the closure to repair pot holes. there was unscripted drama on the la freeway. the bridge goes down a big chunk of that bridge under demolition fell unexpectedly close to a couple workers. those workers got away just in time and nobody was hurt. they have a little story to tell. >> no kidding. >> not sure why they were under there but all is well. stocks are higher this

monday morning. >> cbs money watch. >> overseas markets lower this morning. dropped 1% to a three week low and hong kong was closed for a holiday. the dow fell 49 points but rose 4% for the quarter while the nasdaq lost 20 and rallied more than 6% from july through september. investigators will hear from ben bernaki aimed at buying mortgage back securities. fell last week after the plan will not create jobs. and amazon's new kindle paper white e reader goes on sale this week. was unveiled last month alongside kindle fire tablets devices. the latest version to go head to head.

usually when the morning commute gets underway. watching a couple different incidents. i thought they were accidents initially but turns out they were stalls and this one just cleared. northbound 101 approaching eastbound 80. and another one down toward the santa cruz mountain. turns out that is the stall as well. hopefully that will be cleared here shortly. heads up if you are traveling through the mountains. northbound 17 looks okay. continues to move well. 280 coming through downtown. san jose exit is moving quite nicely. across the bay bridge, this is a shot of the incline section of westbound 80. and you can see it's getting crowded now. likely turn these metering lights on here shortly. that is your time saver traffic. traffic and weather together every ten minutes. >> thank you. the mail keeps
